Limited Warranty Policy
Electronics Manufacturing (EMS) & Contract Manufacturing (CM) Services
What is Covered: Hardware products (“products”) manufactured by Tev5 Electronics Manufacturing or Contract Manufacturing Services and supplied under a valid commercial proposal or customer order. Does not cover proof of concept, samples, and demo units.
Tev5’s warranty is limited to correction of product defects from our workmanship. Tev5 also passes on transferable manufacturer component warranties to the customer but does not warrant components independently.
Limited Warranty Period and Terms
Tev5 warrants the supplied hardware to be free from defects in workmanship for a Limited Warranty Period (period as specified in your proposal or invoice or other writing), applicable from date of delivery (“Original Warranty”).
If the product fails during normal and proper use within the original warranty period, Tev5 wil l,subject to exclusions and at our discretion, repair or replace the defective parts within the product, or the product itself, with items that are functionally equivalent to that as originally supplied, or better, using new or refurbished parts or units. At our option, we may also provide an equivalent credit. All parts replaced under this limited warranty become the property of Tev5.
The product repaired or replaced by Tev5 will be under warranty for the remaining period of the original warranty.
Exclusions from Limited Warranty
The limited warranty will not apply to or be valid under conditions including but not limited to the following:
- EMS and CM services not procured directly from Tev5, but from unauthorized or in-direct channels.
- Malfunction or any type of product defect/failure caused by a component that has been supplied by the customer, or if that component itself within the product fails.
- If the cause is damage caused during transit, and said damage was not reported to Tev5 immediately upon order delivery.
- The serial number of the product (if provided) has been altered, cancelled, removed, or otherwise not valid as identified by Tev5.
- The product has been tampered with, repaired and/or modified by non-authorized personnel.
- There is damage caused by natural disasters, intentional or unintentional misuse, abuse, neglect, acts of war, improper maintenance, or cleaning, or use under abnormal conditions.
- There is damage caused by accidental drops, spills, fire, or power surges.
- There is damage from improper installation, improper connection, or use of parts and/or components or accessories not manufactured or sold by Tev5.
- There is damage from use outside of the operation or storage parameters or environment or reasonably acceptable for similar product usage models deemed industry standard best practices.
- There is damage to or loss of any program, data or removable storage media, or if there are costs from recovering any program or data.
- There is damage from third party software or from virus(es).
- There is software loss or data loss that may occur during repair or replacement.
- Support and costs involved in installing or configuring the product for any third-party software application or hardware device, or network/wireless configuration.
If Service is Required
Returning the product to Tev5 during the warranty period does not automatically imply that it will be repaired or replaced free of charge. Upon receiving the product, Tev5 reserves the right to check the validity of the warranty and the request for warranty service.
Tev5 is not responsible for any of the customer’s confidential, proprietary, or personal information that may be contained in the product which is returned to Tev5 for any reason. To protect their information, customer may remove all such information from the product prior to its return. Tev5 is not responsible for damage or loss of any personal data, programs, or removable storage media. Tev5 is not responsible for the restoration or reinstallation of any software other than software installed by Tev5 when the product was manufactured or its current equivalent.
Limitations of Liability
- If this product fails to work as warranted above, the customer’s sole and exclusive remedy and Tev5’s sole liability shall be repair or replacement or credit. Tev5’ maximum liability under this limited warranty is expressly limited to the lesser of the price paid for the product or the cost of repair or replacement of any hardware components that malfunction under normal use.
- All Tev5 warranty terms and agreements are non-transferable and only apply to the original unit and original purchaser. Tev5 is not liable for a claim made by a third party or made by you for a third party.
- The terms and conditions of this limited warranty constitute the complete and exclusive warranty agreement between customer and Tev5 for the product and supersede any prior agreement or representations made in any Tev5 sales document, literature or advice that may be provided to the customer by any Tev5 representative in connection with the customer’s purchase of the product.
- No change to the conditions of this limited warranty is valid unless it is made in writing by an authorized Tev5 company officer.
- This limited warranty applies only to new products sold and purchased from Tev5.
THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, AND TEV5 SPECIFICALLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
Changes to this Policy
We may update this Warranty Policy from time to time. We will notify you of any changes by posting the new Warranty Policy on our site. For products supplied to customers, the effective Tev5 warranty as of the date of your purchase order will apply.
