Delivery of SMS/MMS or other messaging communications may be affected by your carrier, network congestion, device compatibility, or other factors outside our control. We do not guarantee the delivery, timeliness, or reliability of such communications.
Liability Limitation
To the extent permitted by law, we will not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with your use of the Site, Messaging Services, or these Terms of Service.
This includes, but is not limited to:

These Terms of Service and your use of the Site are governed by the laws of the State of Washington, King County, USA without regard to its conflict of laws principles.

Force Majeure
Tev5 is not liable for any default, delay, or failure in the performance of any of its obligations under these Terms caused directly or indirectly by circumstances beyond our reasonable control, including, without limitation, fire, flood, acts of God, labor disputes, acts of war or terrorism, pandemic, interruptions of transportation or communications, supply shortages, or the failure of any third party to perform any commitment relative to the production or delivery of any equipment or material required for us to perform any obligations hereunder.
Initially, the force majeure event or unforeseeable circumstance shall have the effect of suspending performance hereof. If the force majeure event or unforeseeable circumstance lasts for more than three (3) months and unless agreed otherwise, these Terms of Service shall terminate automatically, without the need to seek a court ruling or serve formal notice. In such event, Tev5 shall not be held liable for the total or partial non-performance of our obligations hereunder.

Information collected through Messaging Services is handled in accordance with our Privacy Policy. We may store message logs, opt-in/opt-out confirmations, and communication metadata as required for compliance.
Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Participation is subject to your carrier’s terms and conditions.
